I am very happy to inform you that the People’s Majlis of the Maldives adopted on 9 April the Domestic Violence Bill, which will for the first time provide legal protection to victims of domestic abuse. The Bill, which now has to be signed by President Waheed, received overwhelming cross-party support at a time when the country has been torn apart by political division.

We are proud that, through your expertise, the IPU had been involved in reviewing of the Bill since October 2010. I would like to sincerely thank you for your valuable contribution to ensuring the success of this endeavour. As you may recall, Ms. Rozaina Adams and Ms. Eva Abdulla, two young Maldivian women MPs from different political parties, were the unfailing architects and drivers of the Bill. They informed us that your comments on the draft bill were very useful and that most of your recommendations were taken on board.

Murdered VAW victim Ruby Rose Barrameda wins in the office of the president!

background: Ruby rose barrameda, sister of actor Rochelle, was found dead inside a steel drum filled with cement, encased in a steel box. a co conspirator turned state witness, Montero, two years after her murder, came out and told the police about the murder upon the order of the Jimenezes. Ruby rose was married to Jimenez III, his father is Atty Jimenez.

In the department of justice, we won the appeal to secretary leila de lima, who reversed the former secretary, and filed an Information (indictment) in court against all three, the husband Jimenez III, his father and his uncle. The Regional trial court of Malabon Judge Docena, suspended the proceedings when Jimenez appealed the resolution of secretary de lima to the President . Last week, President Benigno S Aquino III denied the appeal of the Jimenezes.

Judge Henry Arles of the Regional Trial Court of Kabankalan, Negros Occidental was murdered by an identified gunman in a tricycle a few days ago, while on his way home from court. The Graft Watch Coalition in Negros Occidental condemns the murder of Judge Arles, who was an honest judge. He was our judge in the rape cases of American Victor Pearson, who raped a young girl whom he hired as a househelp. the Supreme Court sustained the conviction of Pearson. Judge Arles will surely be missed not only by his family but also by the community which he served.

On January 3-4, 2007 the Asia Cause Lawyers was organized in New Delhi, with the Lawyers Collective Women�s Rights Initiative as the secretariat. This is a new regional organization of women�s human rights lawyers who are trial lawyers or who are in the academe. �Cause Lawyering� is described as using law, litigation and law reform as an instrument of social change.

Among those who attended the organizational meeting and who will compose the Steering Committee are:
Indira Jaising of Lawyers Collective (New Delhi); Savitri Goonessekere (Professor of Law, Colombo University, Sri Lanka), a former member of the CEDAW Committee of experts and former Vice-Chancelor of Colombo University; Guo Jianmei, founder Director of the Centre for Law Studies and Legal Services of the School of Law, Peking University (China); Anna Wu, current advisor to the Shantou University in Hong Kong, former founding head of the Equal employment Opportunity Commission; Salma Ali (Bangladesh),Executive Director of Bangladesh National Woman Lawyers Association; Akiko Ito, japanese laywer and head of the Disability Division of the U.N. , Rita Kalibonso (Indonesia), heads the organization Mitra Perempuan, and member of the Steering Committee of the National Commission on Violence Against Women, Komnas Perempua, Sapa Malla (Nepal), is a known fearless lawyer in Nepal; Ramamurti Vaigai is an eminent lawyer from Chennai, India, specializing in labour law litigation;Yaowalka Anupaha (Thailand), the Chair of the Human Rights Sub-Committee on Children, Women, Elders and Disabled Persons of the Lawyers Council of Thailand, and Rowena Guanzon (Philipppines), a litigation lawyer, advocate of children�s rights, women�s human rights and judicial reform, writer and lead author of two books on gender equality and women�s rights in the Philippines.

No protection order against women

A male lawyer inquired whether or not a protection order can be lawfully issued by a court against a woman under Republic Act No. 9262 or the Anti-Violence Against Women and Their Children Act of 2004. The answer is no. A Family Court Judge was suspended by the Supreme Court after she issued a temporary protection order against a woman, granting custody of the minor child to the man. The court admiistrator of the Supreme Court at that time was Hon. Locke. This fact is mentioned in my book on Republic Act No. 9262. You can post comments here.
